These conditions of sale are entered into on the one hand by the company Jardin Confort SA, whose registered office is at Route de Lavaux 425, 1095 Lutry, registered in the Commercial Register under number CH-550.0.131.881-3, hereinafter referred to as " Jardin-Confort SA" or "We", and which operates the website www.jardin-confort.ch and, on the other hand, by any individual or legal entity wishing to make a purchase or place an order via our physical store in Lutry or via the website www.jardin-confort.ch (and aliases) hereinafter referred to as "the buyer", "the customer" or "you".
Article 1. Subject
These conditions of sale define the contractual relationship between Jardin-Confort SA and the purchaser, and the conditions applicable to all purchases made via the www.jardin-confort.ch website, by e-mail, by telephone or at the Lutry store. The acquisition of a product through our store or this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products in our store or on the www.jardin-confort.ch website is not directly related to his professional activity and is limited to strictly personal use, and on the other hand, that he has full legal capacity, enabling him to commit himself under the present terms and conditions of sale.
Jardin-Confort SA reserves the right to modify these conditions of sale at any time, in order to comply with any new regulations or to improve the use of its site, without prior notice. Consequently, the applicable conditions will be those in force at the date of the buyer's order.
Article 2. Products and contents
The products offered are those shown on the website www.jardin-confort.ch of Jardin-Confort SA, while stocks last. Jardin-Confort SA reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible, but are not binding on the Seller. They are not contractual. Jardin-Confort SA cannot be held responsible if the information provided on this site is not accurate, complete or up to date. The content of this site is provided for general information purposes only and should not be used as the sole basis for making decisions without consulting primary, more accurate, complete or timely sources of information such as current catalogs, samples and price lists from suppliers and manufacturers. Any reliance on the contents of this site is at the buyer's risk. This applies in particular to delivery times, prices or stock items which may be out of stock. Instantaneous updating of stocks and delivery times is not possible.
Products are always delivered in accordance with the model, illustration or sketch in the current finish or in the product's stock finish, subject to slight deviations in size, color, structure, weight and finish. Deviations are unavoidable, particularly in the case of subsequent/complementary orders, without any further written obligation. Incorrect data/reproductions/measurements due to technical faults in our technical infrastructure or that of our partners are reserved. Decorative items or accessories shown in photos or at the exhibition are not part of the offer if they are not mentioned by name. Accessories and decorative items must be purchased separately. Illustrative photos may not be contractually binding. Unless otherwise confirmed in writing, all items are for private and family use only. For professional use (restaurants, hotels, hospitals, communities, companies, etc.) the warranty may be reduced by the manufacturer.
Jardin-Confort SA reserves the right to modify the content of this site at any time, but is under no obligation to update the information on the site. The purchaser accepts that it is his/her responsibility to monitor changes on the website. Jardin-Confort SA has made every effort to display product colors and images as accurately as possible. Jardin-Confort SA cannot guarantee that the display of any color on the purchaser's screen will be accurate or that the name or description of the color will correspond to an expected reference.
Some content, products and services available on www.jardin-confort.ch may include material from third parties. Links on this site may direct you to third-party websites that are not affiliated with Jardin-Confort SA. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant or assume any liability for any third-party material or web sites, or for any other third-party material, documents, products or services.
Article 3. Prices
The prices shown on the product sheets of the internet catalog are in Swiss francs CHF, all taxes included (VAT included), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Jardin-Confort SA reserves the right to modify its prices at any time. The prices indicated do not include delivery charges and optional services, which are invoiced in addition to the price of the products purchased.
Article 4. Order and payment terms
Before placing an order, the buyer may, if he wishes, create an account on the www.jardin-confort.ch website. The account creation section can be accessed directly from the menu bar. Each time they visit the site, buyers wishing to place an order or consult their account (order status, profile, etc.) can identify themselves using this information, or provide it to the checkout. Jardin-Confort SA offers the buyer the option of ordering and paying for its products in several stages, with several payment options to choose from:

- Payment by bank transfer in advance: the buyer selects the products he wishes to order in the "shopping basket", modifies them if necessary (quantities, references, colors, finishes, etc.), checks the delivery address or enters a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: "Payment by bank transfer in advance". In the final step, the buyer is asked to check all the information, to read and accept the present terms and conditions of sale, and then to confirm the order by clicking on the "Confirm payment" button. This final click constitutes the definitive conclusion of the contract. By validating your payment, you definitively confirm your order and accept all our terms and conditions. As soon as the order has been validated, the buyer will receive a purchase order confirming that the order has been registered. In order to finalize payment and process the order, the purchaser must contact his/her bank to transfer the amount of the order to Jardin-Confort SA's bank account, whose details are communicated to the purchaser. Upon receipt of the transfer, the order will be processed and the buyer will be informed by e-mail. Jardin-Confort SA will ship the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions and stock. Non-payment of an order by bank transfer in advance does not in any way cancel the buyer's obligations, in particular to pay the amount due.
- Secure payment by Paypal, Twint, Postcard, Postfinance, credit card or debit card: the buyer selects the products he wishes to order in the "shopping basket", modifies them if necessary (quantities, references, colors, finishes, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer. The buyer then selects the payment method of their choice. The next step is to check all the information, read and accept the present terms and conditions of sale, and then confirm the order by clicking on the "Confirm payment" button. By validating your payment, you definitively confirm your order and accept all our terms and conditions. Depending on the payment method chosen, the buyer may be redirected to a secure interface (PAYPAL, Postfinance, TWINT) to enter his or her account details, or enter the payment using a QR code (TWINT). If the payment is accepted, the order is registered and the contract definitively formed. Payment by Paypal, Twint, Postcard, Postfinance, bank card or credit card is irrevocable.
Confirmation or validation of payment for an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof and waiver of the right to invoke one's own terms and conditions of purchase. All data supplied and the recorded confirmation shall constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, Jardin-Confort SA will send confirmation of the order by e-mail.

Article 5. Reservation of title
Jardin-Confort SA retains full ownership of the products sold until full payment has been received, including all taxes and charges. Jardin Confort SA reserves the right to reclaim any goods not paid for in full.
Article 6. Withdrawal and returns
Refunds in the form of a voucher only (store credit).
The buyer has a period of 7 calendar days from the date of receipt of the order to exercise his right of withdrawal and return the product to the seller for exchange or reimbursement in the form of a voucher only, without penalty (if the return conditions are fully met), with the exception of the processing and dispatch costs incurred (minimum CHF 8.50) and return costs to be borne by the customer.
- Clauses:
Duration: Our returns policy lasts 7 calendar days from the date of receipt. If 7 calendar days have elapsed since the date of receipt, we can unfortunately no longer take back any item(s) from your order, nor offer a refund* in the form of a voucher or exchange. If the customer is unable to produce dated proof of receipt of the order, the date of dispatch of the order from our premises will be taken into consideration for the start of the 7-day period. The date of physical return of the goods to our premises in Lutry must occur before the end of this 7-calendar-day period.
*Refunds in the form of vouchers only (in-store credit).
Terms and conditions: To be eligible for a return, the item must be unused and in perfect condition. It must show no signs of use. It must also be in its original packaging, unopened, clean and undamaged. The return must have been approved in writing by our customer service department. To process your return request, we need a copy of the receipt or proof of purchase. Customer service: support@jardinconfort.ch.
Returns sent without our prior written consent will not be processed.
Exclusions: Several types of items cannot be cancelled, returned or exchanged: Items ordered specially for the customer from our suppliers or manufacturers (available to order" items), items made with fabric, canvas, textile or leather, items in special sizes or finishes (not from our stock), items with Keramik, stone or Dekton tops and items made with wood. Items on sale or discount. Assembled or unpacked items cannot be taken back as the packaging has been opened and they are no longer in their original packaging. Even if the assembly or unpacking has been done by us, at your request or not. Additional non-returnable items: plants, flowers, gift cards, vouchers, sale items, exhibition ("d'expo") models, health and personal care items, mattresses, linen and cushions. Shipping costs incurred by Jardin Confort are non-refundable, even if offered or free of charge. Shipping costs (minimum CHF 8.50) and return postage will be deducted from the voucher.
In certain situations, only partial refunds* may be granted after agreement and decision by Jardin Confort SA: Items with signs of use or that have been assembled. Any item that is not in its original condition or damaged, with missing parts or without intact factory packaging. Any item returned more than 7 days after delivery.
Only regular-priced items can be refunded*, unfortunately discounted or sale items cannot be refunded*.
*Refunds in the form of vouchers only (in-store credit).
- How to proceed:
Please do not return your purchase directly to the manufacturer. Items must be returned to our store in Lutry with our prior written consent. To return your product, you must bring it to our store Jardin-Confort SA, Route de Lavaux 425, CH-1095 Lutry, or send it to us by parcel post. The cost of return shipment is borne by the customer. The customer also bears the risk of return transport. Depending on where you live, the time required for the exchanged product to reach you may vary. The date of receipt at our premises must be included in the 7-calendar-day period for the right of return and not the date of dispatch. If you are shipping an item, you should consider using a traceable shipping service or purchasing shipping insurance. We do not guarantee that we will receive your returned item or that it will be in perfect condition.
Once your return has been received and inspected by us, we will then send you an e-mail to inform you that we have received your returned item. We will also inform you of the approval or rejection of your refund* or exchange. If the return is approved, your refund* will be processed and a credit will automatically be applied in the form of a voucher for the value of the item (excluding shipping and return costs), as soon as possible.
*Refunds in the form of vouchers only (in-store credit).
Withdrawal, cancellation of order before dispatch:
The buyer may not cancel the order.
If Jardin-Confort is exceptionally authorized to cancel an order, reimbursement will be made in the form of a voucher only. Note: the amount paid cannot be refunded in any form other than a voucher (gift card), as our partners (payment providers and webshop service provider) unfortunately do not reimburse us for the fixed commissions automatically deducted from each order.
Miscellaneous: The clauses governing returns and cancellations have been read and approved for all orders placed by the customer.
Article 7. Delivery, delivery time and costs
The buyer can either collect his order (unassembled items) free of charge from the Lutry store, or have it delivered to his home. A charge may be made for this service.
Deliveries are made to the address indicated on the order form, which can only be within the geographical area initially agreed. For deliveries by parcel, the buyer is usually delivered to his home by the Post Office. If the purchaser is absent, he/she will receive a delivery notice from the letter carrier, enabling him/her to collect the products ordered from the Post Office or from the designated collection point, during the period indicated by the postal services. If the order is not collected within the specified time, a charge may be made for a 2nd delivery. Items ordered for delivery must be available for delivery at Jardin-Confort SA's request within a maximum of 7 days, failing which any storage costs will be charged to the customer.
For deliveries to mountainous regions, we deliver to the nearest valley station. Additional technical equipment (furniture lift, crane, ski lift, helicopter, etc.) is the responsibility of the consignee. Deliveries are not available to areas closed to cars or accessible only by cable car or boat.
When ordering several items, the delivery time of the order can be adapted to the delivery time of the item with the longest delivery time.
The risks associated with transport are borne by the purchaser from the moment the articles leave the premises of Jardin-Confort SA. The purchaser is obliged to check the condition of the packaging and the contents of the goods on delivery in the presence of the letter carrier, carrier or deliveryman. In the event of damage during transport, any protest must be made immediately in writing on the delivery note. Subsequent claims cannot be accepted. Upon receipt, either on delivery or on collection, the purchaser must check the goods for any defects, and in particular for broken glass, broken ceramics and surface defects. Upon receipt, the customer must also check that no items ordered are missing. No subsequent complaints will be accepted. Defects must be reported in writing on the delivery note in the presence of the delivery personnel or Jardin-Confort SA staff. The clause "Subject to unpacking" or other equivalent has no legal value: items must be inspected immediately in the presence of the delivery personnel in order to identify any defects (aesthetic defects, scratches, damage or other anomalies).
Important information on transport damage
Even though we have followed all instructions for correct freight packaging, it may unfortunately happen from time to time that your order arrives damaged at its destination.
We therefore ask you to check the goods immediately on delivery in the presence of the carrier and to note any damage on the delivery note before signing for it.
Why should we do this?
If you do not include this information on the delivery note, you will be accepting damaged items with your signature, confirming that you have received the goods complete and in perfect condition, a "clean receipt".
A claim for damages against the carrier or shipper will not be accepted in the event of a subsequent claim for apparent damage with "clean receipt". Carrier's insurance companies refuse to cover costs in such cases. If a delivery note is signed without any mention of damage, the carrier and his insurer assume that the damage only occurred after delivery.
Unfortunately, our customers are often of the opinion that we have to pay for damages despite the signed delivery note. It goes without saying that we are there for you in the event of transport damage, and are happy to help you settle the claim quickly. But in the case of "clean receipt", we reach our limits, as we do not receive any compensation from the carrier for the costs incurred.
We therefore ask you always to check incoming shipments immediately in the presence of the driver, and to complain immediately in writing of any freight damage. This is the only way to guarantee smooth claims settlement in your interest. Shrink-wrapped pallets should be specially inspected, as damage can sometimes be found under the flexible plastic film that conceals the cartons underneath.
Delivery may consist of several partial deliveries. If Jardin-Confort SA wishes to make partial deliveries, Jardin-Confort SA will bear the additional costs incurred. The purchaser does not have the right to refuse partial deliveries.
Claims for damages arising from delays in delivery are excluded in all cases. Delivery times are given for information only and are expressed in working days. The delivery times given reflect normal delivery times but are indicative and not binding on Jardin-Confort Sa. If delivery times are exceeded, Jardin-Confort Sa cannot be held liable for discounts, cancellations or refunds.
Depending on the size and weight of your order, you may be asked to contribute to delivery costs. Depending on the delivery zone, optional additional services may be offered (delivery to the floor, assembly, unpacking, etc.).
Jardin-Confort SA reserves the right to cancel or adapt at any time the delivery and service charges, the mode of delivery, the assembly services and the mode of delivery chosen and paid for by the purchaser.

ORDERS UP TO 30KG:
Home delivery by parcel post: Only for orders that can be sent by parcel post. Unpacked and unassembled.
If the purchaser does not receive the order on the day of delivery by post, it is the purchaser's responsibility to collect the parcel from the relevant post office or to arrange for another home delivery by post at the purchaser's expense. The cost of returning parcels not collected from the post office is borne by the purchaser.
Maximum order weight: 30kg. Maximum dimensions of the package containing all the items in the order: length: 250cm; circumference: 400cm (2 × height + 2 × width + 1 × longest side).
Free shipping for standard postal parcels (non-bulky*) from CHF 100:

Home delivery by Planzer, BTSwiss, Poste Cargo, Jardin-Confort SA or other carriers.
-Free shipping on orders over 2000
-Lower amounts: CHF 59.00 for French-speaking Switzerland. Supplements according to geographical delivery areas outside French-speaking Switzerland.
No unpacking or assembly. Delivery by parcel or pallet, free at kerbside or downstream station. Goods are unloaded at the kerbside, not taken to their final installation location.
Packaging must be disposed of by the purchaser via the nearest household waste collection center. If the order is delivered on a transport pallet, the carrier may in some cases take back the pallet directly. Otherwise, the purchaser must contact a local waste and recycling center or return it to our store.
The purchaser is responsible for ensuring that delivery vehicles and lorries have good access to his home. He/she must check and confirm without delay if any difficulty arises. As the driver is responsible for delivery and access, the final decision concerning the possibility of delivery rests exclusively with him.
If the buyer does not receive the order on the day of delivery from the carrier, it is the buyer's responsibility to take the necessary steps to request a new home delivery at the buyer's expense. Cost of returning undelivered items are at the buyer's expense.
Delivery is not possible in the following situations (non-exhaustive list):
-If the conditions mentioned for access and egress, as well as for stopping and unloading the truck, are not met.
-In narrow residential areas with lots of parked cars, tight bends and winding streets.
-Location where the delivery address is more than 75 m from where the truck parks and unloads.
-If access is not at least 50 cm wider than the length of the goods.
-Safe unloading is not possible for the driver, as this is a main road with heavy traffic or many bends.
-If the place of delivery is in an area with no access roads or is difficult to reach (e.g. a mountainous region).
DELIVERY WITH SERVICE:
Not available in all regions. Jardin-Confort SA reserves the right to cancel or adapt the delivery method and service chosen by the purchaser. Additional charges for places closed to traffic, unsuccessful deliveries, difficult access and special delivery requirements (e.g. furniture lift, no elevator, elevator too small). The buyer must check the dimensions of the items ordered and measure the accesses, doors, stairs and/or elevator at the delivery address. It is the purchaser's responsibility to ensure in advance that the delivery goes smoothly, without the use of a furniture lift or elevator, or delivery with more than 2 people. If the upstairs delivery location does not have an elevator, or if the size of the packaging of the items ordered does not fit in the elevator, Jardin-Confort SA may reassess the delivery charges or change the delivery method. It is the customer's responsibility to check the dimensions of the packages and the elevator beforehand.
-SILVER" Package Delivery upstairs with unpacking: Delivery to final place of use, including upstairs. Unpacking of items. Return and recycling of packaging. Without assembly. CHF 79.-
-GOLD" package Delivery upstairs and furniture assembly*: Delivery, furniture assembly and installation at home, including upstairs. Return and recycling of packaging. CHF 119.-
*Thefollowing items are excluded from the Gold package and cannot be assembled: Swings, chests, wardrobes, pavilions, shelters, gazebos, awnings, grills and barbecues.
The following services are excluded and cannot be carried out: fixing items to the ground or wall, electrical connections, concreting, preparation of the ground, walls or surfaces, drilling, water and gas connections.
If the purchaser does not receive the order on the day of delivery from the carrier or delivery personnel, it is the purchaser's responsibility to initiate the necessary steps to request a new home delivery at the purchaser's expense. Cost of returning undelivered items are at the buyer's expense.
Article 8. Warranties
All products supplied by Jardin-Confort SA are covered by the legal warranty provided by the Swiss Code of Obligations. In the event of non-conformity of a product sold, it must be returned by the purchaser to Jardin-Confort SA in Lutry, which will take it back, exchange it or reimburse it with prior agreement. All claims, requests for exchange or refund must be made by post to the following address: Jardin-Confort SA, Route de Lavaux 425, CH-1095 Lutry. Manufacturers' warranty clauses are authoritative. Available on request.
Upon receipt, either on delivery or on collection, the purchaser must check that the goods are free from defects and, in particular, that there are no broken glass or ceramics and that there are no surface defects. Upon receipt, the customer must also check that no items ordered are missing. No subsequent complaints will be accepted. Defects must be reported in writing on the delivery note in the presence of the delivery personnel or Jardin-Confort SA staff. The clause "Subject to unpacking" or any other equivalent has no legal value: items must be inspected immediately in the presence of delivery personnel in order to identify any defects (aesthetic defects, scratches, damage or other anomalies). Any manufacturing defects discovered at a later date, i.e. during the legal warranty period, must be reported immediately.
As a general rule, in the absence of any statement to the contrary, Jardin-Confort offers a warranty covering manufacturing defects under the conditions laid down by law from the date of delivery of the goods to the purchaser (first date in the case of multiple deliveries). Replaced parts are guaranteed for the duration of the initial warranty remaining on the day of replacement.
Excluded from warranty: All damage resulting from wear and tear, ageing and improper use, bulbs and leds, wind damage, discoloration caused by sunlight or washing of fabrics (parasols, covers, cushions, canvas, textilene, etc...), surface degradation caused by sunlight and washing (paint, trays, frames, etc...), deformation of textiles due to washing or water, mildew and scratches caused by use. Complaints concerning natural materials such as wood or stone, for example, cannot be taken into consideration for aesthetic reasons. These materials have natural defects and natural variations in color that are accepted by the customer. Wood changes appearance after exposure to sun and rain. Micro-cracks may form on the surface, but this does not affect the quality of the product and is not a defect. Mildew on wood or fabrics is not covered by the warranty. Protective covers and outdoor fabrics are not 100% waterproof. This is not a reason for complaint. Jardin-Confort SA cannot be held responsible for any stains or soiling that may occur after delivery. The customer undertakes to inform himself of the precautions for use, care and washing before using the article. Transformation or modification of the goods by the customer despite the presence of an apparent defect will invalidate the warranty. Jardin-Confort SA or its appointed third-party partner may provide the guarantee in the form of a free repair or by replacing the defective goods with goods of the same value. All other claims are excluded. Jardin-Confort SA reserves the right to refund the purchase price of products on sale, instead of repairing the product free of charge or replacing it with a product of the same value. In principle, sales cannot be returned or exchanged. Warranty claims must be made at our Lutry store. Items deemed to be defective are to be returned by the customer to our premises in Lutry, only after our agreement, even if the item has been delivered by Jardin-Confort to the customer's address. Transport and transport costs are at the customer's expense. The following items are excluded from the guarantee: exhibition furniture. Showroom furniture has been viewed and is sold second-hand at a discount: defects cannot be claimed.
Article 9. Liability
The company Jardin-Confort SA, in the process of distance selling, is only bound by an obligation of means. It cannot be held responsible for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
Article 10. Intellectual property rights
All elements of the www.jardin-confort.ch website are and remain the exclusive intellectual property of Jardin-Confort SA. No one is authorized to copy, reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text and price.
Article 11. Personal data
Jardin-Confort SA undertakes to preserve the confidentiality of information provided by the purchaser, which he may be required to transmit in order to use certain services. All information concerning the purchaser is subject to the provisions of the law. As such, the Internet user has the right to access, modify and delete information concerning him/her. Your submission of personal information in the store is governed by our privacy policy. Please see our privacy policy.
Article 12. User feedback, comments, opinions and other submissions
If, at our request or without a request from us, you send creative ideas, suggestions, proposals, photos, plans or other materials, whether online, by e-mail, by mail or otherwise (collectively, "Comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and use in any medium the Comments you send to us. We are and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay any compensation for any Comments; or (3) to respond to any Comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
You agree that your comments will not violate any rights of any third party, including copyrights, trademarks, privacy, publicity or any other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain computer viruses or other malicious software that could affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or mislead us or others as to the origin of any comments. You are solely responsible for the comments you make and their accuracy. We take no responsibility and assume no liability for comments posted by you or any third party.
